Agreement to Terms

By accessing or using photodyne.com (the "Site") you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Site. These terms apply to all visitors, users, and customers of Photodyne Technologies.

Use of the Site

You may use the Site for lawful, informational, and commercial purposes related to evaluating or purchasing Photodyne products. You agree not to:

  • Copy, modify, or redistribute Site content without written permission, except for personal, non-commercial use.
  • Use the Site in any way that could damage, disable, overburden, or impair our servers or networks.
  • Attempt to gain unauthorized access to any portion of the Site, user accounts, or computer systems connected to the Site.
  • Use any automated system (bots, scrapers) to access the Site without our prior written consent, other than standard search-engine indexing.

Intellectual Property

All content on the Site, including text, graphics, logos, product images, schematics, and software, is the property of Photodyne Technologies or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual-property laws. "Photodyne," "Photodyne Technologies," and related logos are trademarks of Photodyne Technologies.

Product Information

We work to keep product specifications, images, and pricing accurate, but we do not warrant that all information on the Site is error-free, complete, or current. Specifications and availability are subject to change without notice. Custom configurations are quoted individually; pricing and lead times for custom work are confirmed in writing.

Orders, Quotes, and Payment

  • Quote requests are not binding orders. Orders are confirmed only upon written acceptance by Photodyne Technologies.
  • All prices are in U.S. Dollars unless otherwise specified.
  • Payment terms, shipping, and delivery dates are set out on individual quotes and purchase orders.
  • Title and risk of loss transfer to the buyer upon shipment unless otherwise agreed in writing.

Warranty

Photodyne imaging systems include a three-year limited warranty on parts and workmanship beginning from the date of delivery. Warranty coverage, exclusions, and claim procedures are detailed in the warranty documentation accompanying each product. The warranty is non-transferable and does not cover damage from misuse, unauthorized modification, or normal wear.

Limitation of Liability

To the maximum extent permitted by law, Photodyne Technologies shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or our products, including lost profits, lost data, or business interruption, even if we have been advised of the possibility of such damages. Our total liability for any claim related to the Site or a specific product shall not exceed the amount paid by you for that product.

Third-Party Links

The Site may include links to third-party websites, such as social-media, video-embed, or analytics services. We do not control and are not responsible for the content, policies, or practices of those sites. Following third-party links is at your own risk.

Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of the Site shall be resolved in the state or federal courts located in Los Angeles County, California, and you consent to the exclusive jurisdiction of those courts.

Changes to These Terms

We may update these Terms from time to time. Updates are effective when posted on this page, and the "Last updated" date above will be revised. Continued use of the Site after changes constitutes acceptance of the new terms.
